Hepatitis Exposure Lawsuits |

At least 850 patients treated at the Endoscopy Center of Southern Nevada or the Desert Shadow Endoscopy Center have tested positive for hepatitis C, according to their attorneys.
Hundreds, and potentially thousands of these patients are expected to file lawsuits against the clinics and the doctors who worked there, including the main owner, Dr. Dipak Desai.
These patients have alleged that Dr. Desai and other staff at these two Las Vegas clinics engaged in unsafe medical practices which may have exposed them to hepatitis C, hepatitis B, HIV or other blood-borne illnesses.
An investigation by Nevada health authorities revealed that staff at the clinics regularly reused the medicine vials and syringes used to inject patients with anesthesia, as well as the bite blocks which are placed in the mouth during an endoscopy.
In some cases, doctors were performing colonoscopy procedures which usually last from 15 to 30 minutes in as little as two minutes.

As a result of these unsafe practices, the city of Las Vegas revoked the business licenses of the two facilities and issued a $500,000 fine. The city says that it will use this money to organize medical records seized from the clinics and get them to patients as soon as possible.
Lawyers representing the patients who were harmed by the unsafe practices at the two Endoscopy Centers have already met with lawyers for the clinics in order to get the patients cases to trial as quickly as possible. Although a class action lawsuit may be filed in the case, attorneys for the patients are fighting to prevent this from occurring to ensure that the legal rights of each individual are protected.
