Judge orders release of testimony, records from accused Las Vegas endoscopy clinics

A judge in Nevada has ordered the release of key testimony collected during the investigation of the Las Vegas hepatitis outbreak. Judge Allan Earl’s ruling will also bring to light financial and medical records from the Endoscopy Center of Southern Nevada and the Desert Shadow Endoscopy Center, where over 40,000 patients were exposed to hepatitis C as a result of unsafe injection practices.

The owner of the two endoscopy clinics linked to an outbreak of hepatitis C infections has reached a settlement agreement with the first of thousands of former patients who have filed lawsuits in the case. Lawyers for Dr. Dipak Desai—the owner of the Endoscopy Center of Southern Nevada and the Desert Shadow Endoscopy Center—disclosed in court papers filed this week that he has reached a settlement with Michael Washington, a former patient at one of the clinics.
 
Judge allows first Las Vegas hepatitis lawsuits to go forward

A U.S. Bankruptcy Court Judge has stated that he will allow the first of three civil lawsuits filed over the 2008 Las Vegas hepatitis outbreak to go forward. The two endoscopy clinics named in the lawsuits filed for bankruptcy protection in July 2009, which automatically stayed the civil suitss.
 
Doctor in Nevada hepatitis outbreak ruled competent to face charges

The Nevada state Board of Medical Examiners has ruled that the owner of three endoscopy clinics linked to an outbreak of hepatitis C infections is competent enough to face medical malpractice charges. The board ruled that Dr. Dipak Desai was capable of assisting his attorneys in his defense despite suffering a stroke earlier this year.
 
Nevada passes tougher health laws in wake of hepatitis outbreak

The state of Nevada has enacted five new laws that will make health officials better able to respond in the event of a public health crisis. The new laws were proposed in response to an outbreak of hepatitis C infections which took place last year. More than 50,000 patients were exposed to contaminated medical equipment at two Las Vegas-area endoscopy clinics because of unsafe injection practices on the part of their medical staff.
